Madrid, Spain | Actively Working to Regulate its Chaotic Tourist Flat Market

Madrid, Spain’s capital and largest city is actively working to regulate its chaotic flat market through a combination of national and municipal laws implemented throughout 2025. These measures which aim to curb illegal rentals, address overtourism, and protect long - term housing, have already resulted in thousands of lisitngs being removed from booking platforms. 

The number of tourist flats in the city has fallen significantly since the application of the “Plan Reside”. In just four months, Madrid has gone for registering 16.959 tourist home in July 2025 to 14.297 today, according to data from Inside Airbnb.

The decrease is equivalent to 2.662 fewe flats (-15.7%) since August, when the City Council began to apply the new restrictions. 

Similarly, since the implementation of the “Plan Reside”, the Activities Agency (ADA) and the Association of Property Administrators of Madrid have detected that 1.423 accommodations have abandoned tourist use. 

According to El Mundo, a daily newspaper with national scope, based in Madrid, both codies collaborate with the Consistory in the dissemination of information and the control of compliance with the regulations in the communities of owners.

Among the main measures, the “Plan Reside” prohibits the granting of scattered licences in residential buildings in the historic centre and only allows them in buildings with independent access on the ground floor.

The main objective is to avoid coexistence between tourist and residential homes and to curb saturation in the most affected areas of the Spanish capital. The City Council also foresses urban incentives to convert old office buildings into housing.

The tightening of sanctions also appears to have had a deterrent effect. Fines for maintaining an irregular tourist activity start a €30.000 and can reach €100.000 in the event of a repeat offense, compared to the €3.000 that where imposed before the new regulations. 

The Consistory has sent warning letters to the owners, ordering the immediate cessation of unauthorized activities.

The “Reside Plan”, approved in May and in force since the end of August, has been effectively applied for two and half months. Meanwhile, the Spanish Socialist Workers’ Party (PSOE) and Más Madrid, a progressive regional political party are maintaining open legal appeals against the regulations, as they believe they harm the residents of the city centre.
